and Administrator of said William Nock, deceased, appeared and waived the issuing of Summons, and upon his motion, leave is granted him to file his answer, and the same is filed accordingly. And then this cause came on this day to be again heard, upon the papers formerly read, the Answer of the defendant John H. Wise Sheriff and as such Administrator of William T. Nock deceased, with general replication thereto, and the exceptions to Commissioner Oldham's Account filed on the 11th day of June 1875, and was argued by counsel: On consideration whereof, the Court doth adjudge, order and decree, that it be recommitted to Master Commissioner M. Oldham Senior, to report the evidence or admissions upon which the item for Five hundred and eighty five dollars and eighty six cents ($585.86), bearing date April 1st 1862 paid A. Nock (Matthews) orphan of N.W. Nock &c, referred to in the first exception taken to said account; and the item for Five hundred and thirty three dollars and thirty three cents ($533.33) of same date, paid of Nehemiah W. Nock, orphan of Same referred to in the 2d exception, taken to said account, were allowed: And the Court reserves his decision upon said exceptions No.1 & 2 until after the said evidence is reported. And the Court doth overrule the third exception to said report. And the Court being of opinion that the decedent William Nock Senior as Executor of Zadock Nock, deceased, had not fully ascertained and adjusted the amount of his testator, Zadock Nock's indebtedness to his children John H. Nock, Sallie A. Powell, (formerly Sallie A. Nock) William T. Nock and Mary A. Northam (formerly Mary A. Nock) as their late guardian, doth further adjudge, order and decree, that said Master Commissioner Oldham, as further make up and state an account of the transactions of said Zadock Nock, deceased, with each of his said Wards, and as to the 4th, 5th, & 6th. exceptions to said Master's report, doth reserve his decision until after said Master's report of said accounts shall be made: And the Court doth further adjudge, order and decree that said Master Commissioner make report of his proceedings under this decree to the Court as soon as may be. And all further and other directions are reserved.
