To the Honorable Abel P Upshur, Judge of the Circuit Superior Court of Law and Chancery established and held in and for the county of Accomack.
Humbly complaining sheweth unto your Honor your orator, William P Custis, of the said county, executor of the last will and testament of Charles Mason decd. That the said Charles Mason in his lifetime and a certain John Bull senr., of the said county, entered into co-partnership together as purchasers of slaves and traded as such by the style of Bull and Mason, and that they, the said Bull and Mason were equally concerned in interest in the said co-partnership. Your orator also sheweth that the said co-partnership was carried on for several years until [blank] day of [blank] in the year eighteen hundred and [blank], when the same was dissolved by the death of your orator's testator; but your orator is not informed as to the precise time when the said co-partnership commenced. No settlement of the said co-partnership accounts hath ever been made either between your orator's testator and the said John Bull in the lifetime of the former, or between your orator and the said John Bull since the death of your orator's testator, and your orator, since the said dissolution hath repeatedly applied to the said John Bull to come to a final settlement with respect thereto. And your orator charges that the said John Bull hath possessed himself of the said co-partnership books and papers and hath refused to permit your orator to inspect the same; and that the said John Bull hath also refused to render to your orator any account of the co-partnership monies received by him, or to give to your orator any satisfaction in the premises. Your orator also charges that upon a just and true settlement of the said accounts, it would appear that there is considerable balance due to your orator's testator in respect of the said co-partnership dealings.
