Amherst County Court Clerks office March 23d 1821 This day Joseph Dillard made oath before me that Nelson Smith is a material witness in a certain suit depending and undetermined in our said County Court of amherst wherein said Dillard is Dft and Thos. Clasby is Plt and that there is no other witness by whom he can prove material facts in the cause other than the said Smith and that the said Dillard verily believes that it will be out of his power to obtain the personal attendance of said witness on the trial of said cause Given under my hand this 23 day of March 1821 Beverly Davies D.
