Halifax Circuit Court September Term 1850 Ozborne Meadows & wife plaintiffs against Francis Drinkard adm &c defendants } In chancery This cause came on this day to be further heard upon the papers formerly read and upon the report of Commissioner Terry made in pursuance of the order of April Term 1849 to which there is no exception except (as to the report of the advancement) and was argued by counsel On Consideration whereof the Court being of opinion that no satisfactory evidence has been adduced in relation to the value of the advancement doth consider the said advancements as equal in value: And in that this time deciding upon the validity of the claims sought to be set off by the said James M Chappell against the distributive share belonging to the Estate of Beverley Drinkard decd and referring the Commissioners report according to Statement X filed among the Papers of this Cause doth adjudge order and decree that the defendant James M Chappell pay to the plaintiff Ozborne Meadows & Nancy his wife the sum of One hundred and six dollars and fifty two Cents with interest thereon at Six per Centum per annum from 1 day of September 1847 till paid that he pay to Branch Drinkard the sum of Two hundred and sixty five dollars and fifty two Cents with like interest on $206:13 apart hereof from the said 1 day of September 1847 till paid: that he also pay to Edward Watkins and Martha his wife the sum of $66.37 with int on $51:33 a part thereof from the1 day of September 1847 till paid: that he pay to John A Drinkard Wm F Drinkard and Saml B Drinkard each the sum of $66:37 with like int on $51.53 a part thereof from the 1 day of September 1847 till pd: that he pay to Martha Fleming Sarah Anne Drinkard, Frances Drinkard, & John Drinkard children of John Drinkard decd each the like sum of $66:37 with like int on $51:53 or part thereof from the 1 day of Sept 1847 till paid that he pay to Frances Bailey, Martha Bailey Mary Bailey James Bailey & Henry Bailey each the sum of $53.09 with interest on $41:22 a part thereof from the1 day of September 1847 till paid and the Court doth further order that the defendant James M Chappell do render before one of the Commissioners of the Court an account of any offsetts he may have against the distributive share of Beverley Drinkard decd with evidence to prove them before the next term of the Court in Time to enable the Commissioner to examine them so as to make his report to the next Term and that the said Commissioner to examine the account & make report thereof to this Court at the next term and unless the said defendant shall furnish the Comr. with his account and evidence in support of it as required by the order the Court will at the next Term proceed to decide the case when the report among the papers A copy teste Wm Holt c
