To the honorable William Leigh Judge of the Circuit Court of Halifax County, humbly complaining your Orator James M. Chappell respectfully sheweth that at the last term of the Circuit Court for Halifax County a decree was rendered against your Orator in the case of Meadows against himself as admor of Francis Drinkard & others a copy of which is herewith filed Marked A & prayed to be taken as part of this Bill. That said decree was founded upon report of Commissioner Terry made under an order in said cause on the 4" Sept. 1845, a copy of which is also here with filed marked B, that by the said order the Commissioner was required to take an account between your orator and each of the distribution of his intestate Francis Drinkard. Your orator was absent from the state when the said account was taken but left with the said Commissioner his evidence & vouchers for taking said last mentioned account and supposed that the same had been taken and allowed but your orator has since the adjournment of the Court ascertained that no such account has ever been taken.
