To the Honorable George H. Gilmer, Judge of the Circuit Court of Bedford County - The Bill of Complaint of John F Sale and William Witt, surviving Executors of Timothy Rogers dec'd. respectfully represents - That the said Timothy Rogers departed this life in the year 1850, having first made and published his last will and testament in writing, which after his death was proved in the County Court of Bedford County, and ordered to be recorded - that the said testator survived his wife - your orators and the Rev. William Leftwich, the Executor therein named qualified as Executors thereof in the said County - that the said Wm Leftwich has since departed this life leaving your orators the surviving Exors of the said last will and testament [A certified copy of the said will is herewith filed as a part of this Bill marked "A"] The said testator by the second clause of the said will directed that all of his slaves of both sexes and ages, and the children of the females that might be thereafter born, should be eman-
