due Proceedings, that in that behalfe he might Lawfully have had, and made, and those wholesome Laws, made for ye Peace and Quiett of their Maties Subjects, seem slighted, and rendred ineffectuall; their Maties Intrest wronged, their Subjects abused, and this Complaint almost brought to Ruine, by ye Case, and Wicked practices of ye said Geo Brent, and Robt Brent. Wherefore once more he humbly Requests, and in Justice Demands, as well for and on ye behalfe of their Soveraigne Maties as for himselfe, and others, ye good Subjects of this County, that ye said George Brent as a Popish Recusant, and ye said Robert Brent as a Popish Recusant Convict, may be Called by Warrant Sumons or otherwise before this Worppll Court, and ye Oathes appointed, instead of ye Oathes of Alegiance and Supremacie may be tendred to them, and that Certificate thereof be made according to Law; of their Acceptance or Deneyall to ye [dred?] proceedings may be had thereon as by ye Law in that Case is further required. Which said Complaint of ye said Richard Gibson being Publickly read in Court, against ye said Geo Brent as A Popish Recusant and Robt Brent as A Popish Recusant Convict: and they ye said Geo Brent and Robt Brent, being likewise called into Court came in : and to them was Read by ye Clerke ye Complaint aforesd unto which they answared [sic] by Writing under their hands yt they are not Sumoned, and cannot now answare being not Leagally called but at ye next Court will be ready to make their Defence All which being fully Considered by ye Court, the Court are of ye Opinion that they are now Leagally called, and that they ought imediately to Answare to ye Complaint of ye aforesaid Rich Gibson and that ye Oathes appointed in stead of ye Oathes of Alegiance and Supremacie ought to be tendred to them Capt: Malachy Peale, Mr. Matthew Thompson and Mr. John Harvey, Dissents from the aforesaid Opinion, and Judgment of this Court, Alleaging that ye said George Brent, and Robert Brent ought to have time to ye next Court to answare ye Complaint of ye said Ricd Gibson, for that it appeares to them that ye said Defendants are not now Leagally called, and the Oathes and Test aforesaid ought not to be tendred to them as aforesaid from which aforesaid Judgmt of this Court, ye said Geo Brent and Robt Brent, not being therewith Content doe Appeale to
