Jacob & others v Vass' exor


At a court held for Halifax County the 22nd day of October 1832 This writing purporting to be the last will and testament of Philip E Vass decd. was exhibited in court by Isaac Medley Senr. the executor therein named for probate whereupon on the motion of James P Vass and Edward Womack they are admitted defendants to contest the said writing as the last will and testament of the said Philip E Vass decd. And at another court held for the said county the 27th day of November in the year aforesaid It is suggested that the defendant James P Vass has departed this life and on the motion of Alexander Boyd he is admitted a party defendant and this day came the parties by their attorneys and upon the inspection of the writing purporting to be the last will and testament of the said Philip E Vass decd and upon hearing the testimony [Pages overlap and hide most of the words] "[illegible]" the court "[illegible]" last will

[ans?] and Testament of the said Philip E Vass decd and it is considered by the court that the plaintiff recover against the defendants Edward Womack and Alexander Boyd his costs by him expended in prosecuting his motion aforesaid from which order and Judgment the defendant Womack prays an appeal to the Circuit Superior Court of Law and Chancery for this county which is allowed him upon his giving bond with good security in the penalty of $500.00 conditioned as the law directs And at anonther court continued and held for the said county the 30th day of November in the year aforesaid Wm M Cabaniss exor. of the said James P Vass decd. came into court and prayed an appeal from the order and Judgment rendered in this cause the 2nd day of this court to be the next Circuit Superior Court of law and Chancery for this county which is allowed him upon his entering into bond in the penalty of $500.00 which bond was accordingly executed Teste Samuel Williams CK At a Circuit Superior Court of Law and Chancery held for the County of Halifax the _ day of April 1833 Wm. M Cabaniss exor James P Vass decd. appellant against Isaac Medley Senr. exor. of Philip E Vass decd. upon an appeal from an order and Judgment of the County Court of Halifax the 27th day of November 1832 whereby it was ordered that a writing purporting to be the last will and Testament of Philip E Vass decd. should be established and recorded and that the appellee recover his costs.
