to wait the event of his suit or suits the court doth adjudge or demand and decree that Aaron Hardwick, William Wilson Jr, Charles F Edwards, & William T Ballow or any two of them be & They are hereby appointed Commissioners to devided the slaves in the Bill mentioned into five equal parts assigning one of those parts to the plaintiff George B Ewing and Affiah his wife one part to Edward Womock and Sarha L his wife, William M Cabaniss Executor of Jas P Vass decd. one part and one part to the defendant Isaac Medley Sr. as curator of the Estate of Philip E Vass the other fifth part to be left in the hands of Isaac Medley to meet the claim of Preston Parker and await the event of his suit or suits for the recovery of the same and to be subject to the future order of this court that the said Commissioners do proceed to settle, the account current of the said Isaac Medley Sr administrator with the will annexed of Philip E Vass Sr deceased and divide whatever money may be in his hands arrising from the sale of the personal Estate of the said testator in like manner with the slaves and that the said Commissioners report to the Court but the said Isaac Medley Sr shall deliver said parts so divided to the distributees untill each distributee shall execute to him a refunding bond with good security according to the act of assembly for such cases made & provided.
