Your Orators & Oratrices further represent to your Honour that Philip Vass the elder the father of the said Philip E. Vass departed this life in the year and before making and publication of the aforesaid will of the said Philip E., the said Philip Vass the elder having duly made & published his last will & testament which was admitted to [page torn - probate?] in the County Court of Halifax and a copy of which is herewith exhibited as part of this bill: the said will among other devises and bequests, bequeaths specifically to the said Philip E. Vass your Orator and Oratrix Jacob & Mary, and contains a general residuary clause devising and bequeathing certain land "with all the remainder of my estate not already given to be equally divided by Commissioner by Court between my children James P. Vass, Sarah L. Vass Anna Vass, Apphia Vass and P. E. Vass and their heirs forever." And appointed a certain Jarratt W. Cook his executor.who having refused to qualify the said Isaac Medley was appointed administrator with the will annexed of the said decedent; all which will more fully appear by the copy of the said will marked C. and the bond of the said Isaac Medley as administrator and other his securities herewith exhibited as part of this bill and marked D.
