Case of Lewis & Peter vs Preuss and others

In this case on the affidavits of Francis Peyton, Jr. & Thomson F. Mann being filed the defendant Cureton by his counsel moved the court to set aside the agreement for setting the case for hearing as made between said Peyton & Mr. Hewitt & filed in the case. The answer of A. W. Preuss was also upon to same affidavits offered to be filed. But the court refused to set aside said agreement or to finish said answer to be filed and thereupon proceeded to the hearing of the case to which opinion refusal of the court the said Cureton & Preuss objects
